Smerdon loses VCAT Appeal

ROBERT Smerdon yesterday lost his appeal to the Victorian Civil and Administrative Tribunal after it affirmed the decision of the Racing Appeals and Disciplinary Board, which found him guilty of conduct prejudicial to the image, interests or welfare of racing.

Smerdon was found guilty by the RAD Board and fined $10,000 for giving jockey Damien Oliver $11,000 in cash from professional punter Mark Hunter.

The payment was a result of a bet Oliver placed on Miss Octopussy in October 2010 via Hunter, which led to the jockey's disqualification for eight months.

Smerdon can appeal against the fine.

He probably will be paid back by Ollie anyway but some mud will still stick
